Discover Financial Lawsuit

Discover Financial Services has reached a class action settlement over allegations that it used an automated telephone dialing system and/or an artificial or prerecorded voice to place non-emergency telephone calls to a cellular telephone in violation of the Telephone Consumer Protection Act (TCPA). If you received an automated call from Discover Financial Services or any related parties between Nov. 30, 2007 and Sept. 10, 2013, you may be eligible to receive financial compensation.

The Discover telephone call settlement will resolve a class action lawsuit (Steinfeld v. Discover Financial Services, et al.) that alleges Discover Financial Services and related parties placed calls to cellular telephones through the use of an automatic telephone dialing system or artificial or prerecorded voice without the prior express consent of consumers.

Discover denies all of the allegations but has agreed to provide monetary compensation to consumers under a class action settlement that was preliminarily approved on Sept. 10, 2013. Class Members are expected to receive between $20 and $40, either by check or as a one-time credit on their Discover credit card balance.

Class Members of the Discover Financial Services TCPA class action settlement include all persons to whom Discover Financial Services, Discover Bank, The Student Loan Corporation or Discover Home Loans placed a non-emergency telephone call to a cellular telephone through the use of an automatic telephone dialing system and/or an artificial or prerecorded voice between Nov. 30, 2007 and Sept. 10, 2013.

The only way to receive compensation from the action settlement is to submit a valid claim form postmarked no later than Feb. 25, 2014. Detailed claims filing instructions are included below.

Who’s Eligible

If you received an automated call from Discover Financial Services or any related parties between Nov. 30, 2007 and Sept. 10, 2013, you may be eligible to receive financial compensation.

Potential Award

Class Members are expected to receive between $20 and $40, either by check or as a one-time credit on their Discover credit card balance.

    both my partner and I received e-mails from the administrator over the weekend with a claim number for each of us so that we could file. we are going to hold off until closer to the deadline because we also received contact from the administrator in regards to the 1800contacts settlement and don’t want to get denied for filing too many in a short time.

    I have two different Discover cards but am not sure I qualify. I got tons of automated calls from “Rachel” at Card Holder Services. One is through Sam’s club and the other just a Discover card. Do they qualify? And I can prove I had them and I also sent complaints for the State and Federal “Do not call list” at the time. The calls were to my cell phone.

    I received many calls from Discover Student Loans many times constantly in January 2012-July 2012. I filed a complaint with BBB/FCC to ask them to stop calling me constantly, they finally granted my request and did not receive any more calls. They called me all day and night and while I was at work. Now I just get constantly mail from them 4-5 letters a month to invite me to apply for a student loan, no thank you. I have called and asked them to stop mailing me junk and it still happens. I regretted signing a loan with Discover!

    It has come to my attention, both through my own experience and reading hundreds of other accounts, that Discover is ripe for another Class Action Suit – systematically re-victimizing the victims of Identity Theft to avoid closing out accounts. In my case they closed the account for Fraud (they agreed I did not open the account, and it was fraudulently opened) but found a loophole and are holding me responsible for all charges. I am not the only one as stated above. With Identity Theft now moving into the first slot as the fastest growing crime in the USA something must be done and soon to stop Discover and their predatory practices against victims of Identity Theft.
